1. Acceptance of Terms

By accessing or using Planning Alerts ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service. We reserve the right to update these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Planning Alerts is a free service that aggregates publicly available planning and development application information from Australian council portals and delivers email alerts to subscribers based on their nominated address and search radius. We do not create, endorse, or verify the accuracy of any planning application data — all data is sourced directly from council portals.

3. Use of the Service

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the Service. You must not:

  • Use automated tools to scrape or harvest data from the Service at scale without prior written consent.
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure.
  • Use the Service for any commercial purpose without our express written permission.
  • Impersonate any person or entity or falsely represent your affiliation with any person or entity.
  • Transmit any material that is unlawful, harassing, defamatory, or otherwise objectionable.

4. Data Accuracy

Planning application data is sourced from third-party council portals and is provided "as is" without any warranty of accuracy, completeness, or timeliness. Planning Alerts is not liable for any errors or omissions in the data. You should always verify planning information directly with the relevant council before making any decisions based on it.

5. Email Alerts

By subscribing to email alerts you agree to receive periodic email notifications from Planning Alerts. You may unsubscribe at any time by clicking the unsubscribe link in any alert email or by managing your subscriptions through your account. We will not use your email address for any purpose other than delivering the planning alerts you have requested.

6. Comments

Where the Service allows you to submit comments or feedback on planning applications, you are solely responsible for the content of those submissions. You grant Planning Alerts a non-exclusive licence to display such content as part of the Service. We reserve the right to remove any comment that we deem to be inappropriate, unlawful, or in breach of these terms.

7. Intellectual Property

All content on the Planning Alerts website — including logos, design, text, and code — is the property of Planning Alerts or its licensors and is protected by applicable intellectual property laws. Planning application data remains the property of the respective councils and is reproduced under fair dealing principles for the purpose of informing the public.

8. Limitation of Liability

To the maximum extent permitted by law, Planning Alerts and its operators shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. The Service is provided on an "as is" and "as available" basis without warranties of any kind.

9. Third-Party Links

The Service may contain links to council websites and other third-party services. These links are provided for your convenience only. Planning Alerts has no control over the content of those sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time and for any reason, including if we reasonably believe you have violated these terms. You may discontinue use of the Service at any time by unsubscribing from all alerts.

11. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes arising from these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales.
